This study aimed to develop a valid and reliable performance analysis template for quantifying team action variables in elite men’s wheelchair basketball. First action variables and operational definitions were identified by the authors and verified by an expert panel of wheelchair basketball coaching staff in order to establish expert validity. A total of 109 action variable were then placed into 17 agreed Categorical Predictor Variable categories. The action variables were then used to develop a computerized performance analysis template for post-event (...) analysis. Each possession (n = 200) from an international men’s wheelchair basketball game was analyzed by the first author on two occasions for assessment of intra-observer reliability and by a coach and a performance analyst for inter-observer reliability. Percentage error and Weighted Kappa coefficients were calculated to compare the levels of error and agreement for each action variable. Primary legislation in Britain has enshrined the 'voluntary principle' at the centre of the working relationship between nature conservationists and other land-users. This paper examines the dilemma that arises from the application of the legislation to long-term land management strategies in support of nature conservation. This book presents a comprehensive theory of the ethics and political philosophy of public health surveillance based on reciprocal obligations among surveillers, those under surveillance, and others potentially affected by surveillance practices. Public health surveillance aims to identify emerging health trends, population health trends, treatment efficacy, and methods of health promotion--all apparently laudatory goals. Nonetheless, as with anti-terrorism surveillance, public health surveillance raises complex questions about privacy, political liberty, and justice both of and in data use. Individuals and groups can (...) be chilled in their personal lives, stigmatized or threatened, and used for the benefit of others when health information is wrongfully collected or used. Transparency and openness about data use, public involvement in decisions, and just distribution of the benefits of surveillance are core elements in the justification of surveillance practices. Understanding health surveillance practices, the concerns it raises, and how to respond to them is critical not only to ethical and trustworthy but also to publicly acceptable and ultimately sustainable surveillance practices. The book is of interest to scholars and practitioners of the ethics and politics of public health, bioethics, privacy and data technology, and health policy. These issues are ever more pressing in pandemic times, where misinformation can travel quickly and suspicions about disease spread, treatment efficacy, and vaccine safety can have devastating public health effects. Statutes criminalizing behavior that risks transmission of HIV/AIDS exemplify use of the criminal law against individuals who are victims of infectious disease. These statutes, despite their frequency, are misguided in terms of the goals of the criminal law and the public health aim of reducing overall burdens of disease, for at least three important reasons. First, they identify individual offenders for punishment, a paradigm that is misplaced in the most typical contexts of transmission of infectious disease and even for HIV/AIDS, (...) despite claims of AIDS exceptionalism. Second, although there are examples of individuals who transmit infectious disease in a manner that fits the criminal law paradigm of identification of individual offenders for deterrence or retribution, these examples are limited and can be accommodated by existing criminal laws not devoted specifically to infectious disease. Third, and most importantly, the current criminal laws regarding HIV/AIDS, like many other criminal laws applied to infectious disease transmission, have been misguided in focusing on punishment of the diseased individual as a wrongful transmitter. Instead of individual offenders, activities that enhance the scale of disease transmission—behaviors that might be characterized as ‘transmission facilitation’—are a more appropriate target for the criminal law. Examples are trafficking in human beings (including sex trafficking, organ trafficking, and labor trafficking), suppression of information about the emergence of infection in circumstances in which there is a legally established obligation to disclose, and intentional or reckless activities to discourage disease treatment or prevention. Difficulties remain with justifications for criminalizing even these behaviors, however, most importantly the need for trust in reducing overall burdens of disease, problems in identifying individual responsible offenders, and potential misalignment between static criminal law and the changing nature of infectious disease. Whilst some philosophical progress has been made on the ethical evaluation of playing video games, the exact subject matter of this enquiry remains surprisingly opaque. ‘Virtual murder’, simulation, representation and more are found in a literature yet to settle into a tested and cohesive terminology. Querying the language of the virtual in particular, I suggest that it is at once inexplicit and laden with presuppositions potentially liable to hinder anyone aiming to construct general philosophical claims about an ethics of gameplay, (...) for whom assumptions about the existence of ‘virtual’ counterparts to morally salient phenomena may prove untrustworthy. Ambiguously straddling the pictorial and the performative aspects of video gaming, the virtual leaves obscure the ways in which we become involved in gameplay, and particularly the natures of our intentions and attitudes whilst grappling with a game; furthermore, it remains unclear how we are to generalise across encounters with the virtual. I conclude by briefly noting one potential avenue of further enquiry into our modes of participation in games: into the differences which a moral examination of playfulness might make to ethical evaluation. In the wake of the Dobbs decision withdrawing federal constitutional protection for reproductive rights, the United States is in the throes of federalist conflicts. Some states are enacting draconian prohibitions of abortion or gender-affirming care, whereas other states are attempting to shield providers and their patients seeking care. This article explores standard arguments supporting federalism, including that it allows for cultural differences to remain along with a structure that provides for the advantages of common security and commerce, that it provides (...) a laboratory for confined experiments, that it is government closer to the people and thus more informed about local needs and preferences, and that it creates layers of government that can constrain one another and thus doubly protect rights. We contend that these arguments do not justify significant differences among states with respect to the recognition of important aspects of well-being; significant injustices among subnational units cannot be justified by federalism. However, as nonideal theorists, we also observe that federalism presents the possibility of some states protecting rights that others do not. Assuming that movement among subnational units is protected, those who are fortunate enough to be able to travel will be able to access rights they cannot access at home. Nonetheless, movement may not be readily available to minors, people without documentation, people with disabilities, people who lack economic resources, or people who have responsibilities that preclude travel. Only rights protection at the federal level will suffice in such cases. (shrink)

Organ trafficking and trafficking in persons for the purpose of organ transplantation are recognized as significant international problems. Yet these forms of trafficking are largely left out of international criminal law regimes and to some extent of domestic criminal law regimes as well. Trafficking of organs or persons for their organs does not come within the jurisdiction of the ICC, except in very special cases such as when conducted in a manner that conforms to the definitions of genocide or crimes (...) against humanity. Although the United States Code characterizes trafficking as a transnational crime with national implications, (22 U.S.C. § 7101(b)(24) (2010)), trafficking is rarely prosecuted in domestic courts. It has thus functioned in practice largely as what might be judged a stateless offense, out of the purview of both international and national courts. Yet these forms of organ trafficking remain widespread—and devastating to those who are its victims. In this article, we begin by describing what is known about the extent of organ trafficking and trafficking in persons for the purpose of removal of organs. We then critically evaluate how and why such trafficking has remained largely unaddressed by both international and domestic criminal law regimes. This state of affairs, we argue, presents a missed chance for developing the legitimacy of international criminal law and an illustration of how far current international legal institutions remain from ideal justice. Beginning on 7 October and going through to 28 October bishops from all over the world are to gather at a Synod on 'New Evangelization for the Transmission of the Christian Faith.' On 11 October, midway through the Synod, the whole Church will mark the fiftieth anniversary of the opening of the Second Vatican Council. The bishops who are to gather this year (...) at the Synod follow in the footsteps of the more than 2000 Bishops who gathered at the Second Vatican Council. John XXIII opened the Second Vatican Council, with the following words 'Looked at one way there is the deposit of faith or the truths which are contained in our doctrine which we venerate, looked at another way there is the way by which the same (the deposit of faith) is enunciated both in its meaning and its spirit.' In a recent interview for Salt and Light Television the inaugural head of the Pontifical Council for the promotion of the New Evangelisation Archbishop Salvatore Fisichella noted that what Vatican II did for the Church is still present in our community. Later in the interview the Archbishop stated that the 'New Evangelisation is not a new work, it is a new mentality; a new language, a new enthusiasm for announcing the gospel.' There is continuity between both the spirit and letter of the Archbishop's words recorded in 2012 and the words of John XXIII in opening Vatican II. That is, as a Church, what we are seeking is new ways to announce the meaning and spirit of the deposit of faith, the truths contained in doctrine. What would later be called the new evangelisation permeated Vatican II. (shrink)

These volumes of Mill's letters have been awaited eagerly by all scholars in the field of nineteenth-century studies. They inaugurate most auspiciously the edition of the Collected Works of John Stuart Mill planned and directed by an editorial committee appointed from the Faculty of Arts and Science of the University of Toronto and from the University of Toronto Press. In this collection of 537 letters and excerpts of letters are included all the personal letters available. It contains 238 hitherto (...) unpublished letters and 72 letters with previously unpublished passages. Letters previously published have been recollated whenever possible. Western art gardens have enjoyed a chequered relationship with philosophical aesthetics. At different times, they have been both lauded and rejected as exemplars of art, and, for most of the last 150 or so years, they have been largely ignored. However, during the last 25 years, there has been a welcome resurgence of philosophical interest in such gardens. This study situates the work stemming from this revival of interest in its historical context and assesses its adequacy in accounting for gardens (...) in accordance with a range of pan-art criteria. The study argues that contemporary philosophical accounts of gardens are inadequate in some important ways, particularly with respect to gardens’ temporality, ontology, and arthood, and the ways in which gardens are experienced. In response to the arguments of Amie Thomasson, Dominic McIver Lopes, and some other contemporary philosophers, which advocate philosophical accounts of individual arts rather than pan-art accounts, the study develops a partial, new account of gardens that aims to remedy the perceived inadequacies in existing accounts. The new account claims that gardens are singular, not multiple, artworks and that they have an identity not unlike that possessed by humans and other animals; that, metaphorically speaking, our garden experiences may be helpfully illuminated by the application of theories developed in the context of contemporary, improvisatory dance; and that the “ordinariness” of many of gardens materials may be better understood in terms of Arthur Danto’s claim that esse est interpretari, that is, that meaning and value derive from the interpretative process. The new account also proposes personhood as a potentially useful heuristic for understanding how gardens are experienced and understood. The concept of “garden,” and the related constitutive garden aspects, features, and issues are established at the opening of the study with reference to an actual garden. Thereafter, the sources on which the study draws, and which it critiques, are all archival. They include recent philosophical monographs by Mara Miller (The Garden as Art), Stephanie Ross (What Gardens Mean), and David Cooper (A Philosophy of Gardens), and a range of historical and other contemporary monographs and papers written by philosophers, garden historians, and landscape architects and theorists. The Earlier Letters of John Stuart Mill, published in two volumes in 1963, were well received by critics and scholars alike. The publication of these four volumes of later letters completes this edition of Mill's personal correspondence. These volumes contain over 1,800 letters, most never before published, and some sixty earlier letters that have come to light since the publication of the first two volumes of correspondence. The letters have been assembled from widely dispersed collections in the libraries of (...) fifty-eight institutions and of some thirty private collections in Britain and in other countries of the Commonwealth, Europe, and North America.
